Terms and Conditions

Fee Rules / Activity Notes

  1. Diving activity fees include lunch, beverages, boat boarding fees, rental of air tanks, lead weights, and weight belts.
  2. Diving activity fees do not include diving guides. Should you require diving guide services, please inquire with our center.
  3. Before the activity begins, our staff will verify the divers' diving qualifications (C-card). If valid proof is not provided, our center reserves the right to prohibit individuals without valid certification from participating in the diving activity.
  4. Diving activities will be conducted in small groups (Buddy System), with each group consisting of a minimum of 2 certified divers.
  5. Specific dive sites may only recommend to experienced divers with no fewer than 60 recorded dives, and participants must bring their own compass.
  6. Those who do not meet the above requirements must either be matched with a buddy group equivalent to at least an SSI Dive Guide qualification or opt for paid dive guide services (please apply before registration).
  7. All boarding customers and divers must sign an activity waiver. Divers with equivalent SSI Open Water Diver qualifications must sign an additional waiver to ensure a comfortable and safe diving experience. The waiver will be sent out after registration for the participant's review and agreement.

Reservation Cancellation and Refund Policy

  1. In the event of absenteeism on the day of the activity, regardless of the reason (such as unstable weather, lateness, medical documentation, etc.), no fees (including equipment rental) will be refunded, and changes to the diving date will not be accepted.
  2. If you need to change the date of the sea outing after registration, please notify us at least 3 working days in advance; otherwise, an administrative fee of $300 will apply.
  3. Except in cases where the trip is cancelled by our center, all payments and fees made through any channel or paid in error are subject to a 5% administrative fee per transaction if a refund is requested.
  4. After our center approves the refund, it will be processed within 14 business days. If you have not received the funds after this period, please contact us as soon as possible to inquire.

Cancellation Due to Weather Conditions

  1. Our center reserves the right to modify or cancel the trip prior to its commencement if diving activities are deemed unsafe on the scheduled day, or are forecast to be unsafe, due to reasons including, but not limited to, weather conditions, safety concerns, or unforeseen circumstances. In such cases, participants may elect to reschedule their dive or receive a refund; however, our center will not be liable for any compensation beyond the refund of fees paid.
  2. If a No. 1 typhoon signal is hoisted or a thunderstorm warning, or yellow or red rainstorm warning is issued within 2 hours before the assembly time, the activity will proceed as scheduled. Failure to attend will result in no refund (including equipment rental) or changes to the diving date.
  3. If a No. 3 or higher typhoon signal is hoisted, or a black rainstorm warning is issued within 2 hours before the assembly time, the activity will be automatically canceled and rescheduled.
  4. In the event that the activity cannot proceed due to safety reasons (e.g., weather conditions, safety concerns, unforeseen circumstances), we reserve the right to make immediate changes to the itinerary or make alternative arrangements without any compensation or refund. Our center holds the final decision-making authority.
  5. In the case of adverse weather conditions during the journey, the captain has the authority to change the location to a safer spot or to terminate the activity immediately and return, with no refunds provided for the fees paid.
  6. The boarding location may be subject to change depending on the itinerary. Details will be provided during registration, and any changes will be communicated via phone.

Our center retains the ultimate right of interpretation and decision with respect to the foregoing terms and conditions.

Safety Guidelines / Waiver

We recommend that divers use dive computers, compasses, and surface markers on every dive. If you require rentals, please make a reservation during registration for proper arrangements to be made. If our staff observes any behavior endangering safety or the use of unsafe equipment, we reserve the right to immediately terminate the diving activity without compensation or refund. In the event of separation from a buddy underwater, a maximum of 1 minute may be spent searching; thereafter, resurface immediately and wait for your buddy. If your buddy does not resurface within 3 minutes, immediately inform the Boat Manager, dive guide, captain, or onboard staff for appropriate action. All divers must adhere to our safety guidelines and sign a waiver before entering the water. If our staff observes any diver not complying with safety guidelines or not signing the waiver, we reserve the right to immediately terminate their diving activity without compensation or refund. We recommend that you visit the Hong Kong Underwater Association website to read the safety guidelines before your departure for detailed information: http://www.hkua.org.hk/?page_id=24

Liability Waiver and Assumption of Risk Agreement

I hereby acknowledge that I am aware that snorkeling and scuba diving carry the potential risk of serious injury, even death. Additionally, I understand that the use of compressed air for scuba diving may result in various inherent risks, including but not limited to decompression sickness, air embolism, or other high-pressure injuries requiring recompression therapy. I also understand that the training and certification required for open water trips may involve travel to locations that are distant in time, distance, or both from facilities for recompression treatment listed above. Despite the possible absence of recompression or medical facilities near dive sites, I choose to participate in this activity. I understand and agree that Dive Buddy Limited and its affiliated companies, subsidiaries, employees, supervisors, agents, franchisees, or assignees (hereinafter collectively referred to as the "Releasors") shall not be held liable for any injuries, death, or losses suffered by me, my family, property, heirs, or assignees due to my participation in this activity or any negligent acts, whether active or passive, by the Releasors. To be granted permission to participate in this activity, I am willing to assume all risks associated with the activity, including but not limited to all risks that may arise during my participation in the activity, including but not limited to classroom activities, confined water activities, or open water activities, whether such risks are foreseeable or unforeseeable. I hereby waive the Releasors from any claims and lawsuits brought by me, my family, heirs, or assignees seeking compensation for or arising from my participation in this course, whether during the course or after my certification. I understand that snorkeling and scuba diving are strenuous physical activities, and I will make my best effort during the course. Should I sustain injuries due to a heart attack, panic, over-breathing, etc., during the course, I acknowledge and accept the risk of such injuries. Similarly, I waive and renounce my right to prosecute the individual or company listed above for liability. Furthermore, I declare that I have reached the legal age and have the legal capacity to sign this liability waiver or have obtained written consent from my parents or guardians. I understand that the terms in this document are legally binding and not merely descriptive. I sign this document voluntarily and with the understanding that I have relinquished my legal rights, and I further understand that if any term in this agreement is found to be unenforceable or invalid, such term may be severed from this agreement. The remaining terms in this agreement will be deemed to have never included the unenforceable term. I understand and agree that I am waiving not only the right to sue the Releasors but also the right of my heirs, assignees, or beneficiaries to sue the Releasors in the event of my death. I also declare that I can represent my heirs, assignees, or beneficiaries in agreeing to this, and therefore, these parties cannot claim compensation. Through this document, I exempt and release my coaches, the institution providing me with instruction, Dive Buddy Limited, and the entities defined above from all obligations and liabilities for any bodily injuries, property damage, or wrongful death resulting from any cause, including but not limited to negligent acts, whether active or passive, by the Releasors.
